Agreement to Terms
Welcome to the Terms of Service (these “Terms”) for oceanir.ai (the “Website”), provided by Oceanir (“Company”, “we”, “us”, or “our”). These Terms constitute a legally binding agreement between you, whether personally or on behalf of an entity (“You”), and Oceanir, concerning your access to and use of our platform, APIs, and services.
By accessing, browsing, or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you are expressly prohibited from using the Services and must discontinue use immediately.
We reserve the right, in our sole discretion, to make changes or modifications to these Terms at any time and for any reason. We will alert you about any changes by updating the “Last updated” date of these Terms, and you waive any right to receive specific notice of each such change.
1.1 Acceptance Methods
You accept these Terms by: (a) clicking a button indicating acceptance; (b) creating an account; (c) using any aspect of the Services; or (d) continuing to use the Services after being notified of changes to these Terms.
1.2 Authority to Bind
If you are accepting these Terms on behalf of a company or other legal entity, you represent and warrant that you have the authority to bind such entity to these Terms, in which case “You” shall refer to such entity.
Service Description
Oceanir provides an image analysis and geo-estimation inference platform that uses probabilistic machine learning models (including but not limited to the “Orca” series) to estimate the likely geographic origin of visual media.
Oceanir is intended for property verification, due diligence, research, and investigative analysis, not for identifying or tracking private individuals.
2.1 Eligibility
The Services are intended solely for users who are eighteen (18) years of age or older. Any registration by, use of, or access to the Services by anyone under 18 is unauthorized, unlicensed, and in violation of these Terms. By using the Services, you represent and warrant that you are 18 or older and have the legal capacity to enter into these Terms.
2.2 Probabilistic Nature
You acknowledge that the Services utilize probabilistic machine learning models. Output is a statistical prediction, not a statement of absolute fact. Accuracy varies significantly based on environmental factors, image resolution, and model limitations. You agree not to rely on the Services as the sole basis for high-stakes decisions, including legal, medical, or safety-critical actions.
2.3 Service Tiers
We offer multiple service tiers including free, pro, and enterprise plans. Each tier has specific usage limits, features, and pricing as described on our pricing page. We reserve the right to modify tier offerings at any time.
2.4 Modifications
Oceanir reserves the right to modify, suspend, or discontinue the Services (or any part thereof) at any time with or without notice. You agree that Oceanir will not be liable to you or to any third party for any modification, suspension, or discontinuance of the Services.
2.5 Beta Features
From time to time, we may offer beta or experimental features. These features are provided “as is” without any warranties and may be discontinued at any time without notice. Your use of beta features is at your own risk.
User Responsibilities
As a user of the Services, you are responsible for all activities that occur under your account.
- Account Security. You agree to maintain the confidentiality of your password and account details and are fully responsible for all activities that occur under your password or account. You must notify us immediately of any unauthorized use.
- Data Rights. You warrant that you possess all necessary rights, licenses, consents, and permissions to upload, process, and analyze any content you submit to the Services. You must not upload content that infringes third-party rights.
- Accurate Information. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.
- Compliance. You agree to comply with all applicable local, state, national, and international laws and regulations in connection with your use of the Services, including data privacy laws (GDPR, CCPA) and export control regulations.
- Responsible Use. You agree to use the Services responsibly and ethically, respecting the privacy and rights of individuals who may be depicted in images you analyze.
Prohibited Activities
You may use the Services only for lawful purposes and in accordance with your selected plan. Paid plans may be used for internal commercial workflows. You may not commercialize the Services themselves, including by cloning, scraping, reselling platform access, or offering competing services built on unauthorized extraction.
System Integrity
- Reverse engineering, decompiling, or disassembling any aspect of the Services.
- Attempting to bypass rate limiting, authentication, or security mechanisms.
- Using automated scripts, bots, or scrapers outside approved API tiers or in ways that circumvent account or usage controls.
- Introducing viruses, trojans, or malicious code.
- Attempting to probe, scan, or test the vulnerability of our systems.
- Interfering with or disrupting the integrity or performance of the Services.
Ethical Use
- Stalking, harassment, or gathering intelligence on individuals without consent.
- Facilitating doxxing or targeted violence.
- Uploading CSAM (Child Sexual Abuse Material) or illegal content.
- Using the service for military targeting or unlawful surveillance.
- Tracking individuals for purposes of intimidation or harm.
- Attempting to identify a private individual's home address from personal photos.
- Using images of private individuals without a lawful basis, consent, or other valid legal authority.
- Any activity that violates human rights or dignity.
Commercial Restrictions
- Reselling, sublicensing, or redistributing the Services without explicit written permission.
- Using the Services to build a competing product or service.
- Reselling raw or bulk outputs as a standalone product or dataset without explicit written permission.
- Removing, altering, or obscuring any proprietary notices.
- Using the Services for any illegal purpose or in violation of any laws.
- Exceeding any usage limits or quotas without proper licensing.
Violation of these prohibitions will result in immediate account termination, a permanent ban, and referral to law enforcement authorities where applicable.
Unauthorized Access
Unauthorized access to Oceanir systems, infrastructure, networks, databases, APIs, or any other component of the Services is strictly prohibited and constitutes a federal crime under United States law.
Any attempt to gain unauthorized access to the Services, including but not limited to accounts, servers, networks, databases, or any protected systems, is a violation of applicable computer crime laws and these Terms of Service.
5.1 Applicable Laws
Unauthorized access to Oceanir systems violates the following laws and regulations:
- Computer Fraud and Abuse Act (CFAA) — 18 U.S.C. § 1030: Federal law prohibiting unauthorized access to protected computers.
- Electronic Communications Privacy Act (ECPA) — 18 U.S.C. § 2510: Prohibits unauthorized interception of electronic communications.
- Identity Theft and Assumption Deterrence Act — 18 U.S.C. § 1028: Prohibits identity fraud and credential theft.
- State Computer Crime Laws: Various state statutes including California Penal Code § 502.
- International Cybercrime Laws: Including the Budapest Convention on Cybercrime.
5.2 Prohibited Conduct
The following activities are expressly prohibited and constitute unauthorized access:
- Accessing accounts, data, or systems without authorization or in excess of authorization.
- Attempting to bypass, circumvent, or disable authentication or security mechanisms.
- Using brute-force attacks, credential stuffing, or password cracking techniques.
- Exploiting vulnerabilities, including zero-day exploits, SQL injection, XSS, CSRF, or other attack vectors.
- Deploying malware, ransomware, trojans, keyloggers, or other malicious software.
- Conducting network reconnaissance, port scanning, or vulnerability scanning without authorization.
- Intercepting, monitoring, or sniffing network traffic.
- Social engineering, phishing, or pretexting to obtain credentials or access.
- Session hijacking, cookie theft, or token manipulation.
- Accessing or attempting to access other users' accounts or data.
5.3 Penalties & Enforcement
Violations may result in severe legal consequences:
- Criminal Penalties: Fines up to $250,000 and imprisonment up to 20 years under CFAA.
- Civil Liability: Compensatory damages, statutory damages, and attorney's fees.
- Injunctive Relief: Court orders prohibiting further access or activity.
- Account Termination: Immediate and permanent ban from all Oceanir services.
- Law Enforcement Referral: Full cooperation with FBI, Secret Service, and other agencies.
5.4 Monitoring & Detection
Oceanir actively monitors all systems for unauthorized access attempts using advanced intrusion detection systems, behavioral analytics, and security information and event management (SIEM) tools. All access attempts are logged and retained for forensic analysis. We maintain 24/7 security operations and will pursue legal action against any individual or entity that attempts unauthorized access.
5.5 Responsible Disclosure
If you discover a security vulnerability in our systems, we encourage responsible disclosure. Please report vulnerabilities to security@oceanir.ai. Do not exploit, publicize, or share vulnerabilities before giving us reasonable time to address them. Good-faith security researchers acting in accordance with our responsible disclosure policy will not be subject to legal action.
Warning
By accessing Oceanir services, you acknowledge that unauthorized access is a serious criminal offense. We will pursue all available legal remedies against violators to the fullest extent of the law.
Intellectual Property
Unless otherwise indicated, the Services and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Services (collectively, the “Content”) and the trademarks, service marks, and logos contained therein (the “Marks”) are owned or controlled by us or licensed to us.
6.1 Your Content
You retain full ownership of any intellectual property you upload to the platform. By uploading content, you grant Oceanir a limited, non-exclusive, worldwide license to process, store, and display that content solely to provide, secure, and support the Services. By default, we do not use your uploaded media to train Oceanir models. Model training on uploaded media is available only if you explicitly opt in through your account settings, and any opt-out applies prospectively.
6.2 Our Content
The Content and Marks are provided “AS IS.” Subject to your plan, we grant you a limited, revocable, non-transferable, non-sublicensable license to access and use the Services, including internal commercial use for paid plans. You may not copy, reproduce, aggregate, republish, upload, post, publicly display, encode, translate, transmit, distribute, sell, license, or otherwise exploit the Services, Content, or Marks beyond the rights expressly granted in these Terms.
6.3 Feedback
Any feedback, suggestions, or ideas you provide regarding the Services shall become our exclusive property. We may use, copy, modify, and distribute such feedback without any obligation to you.
6.4 DMCA Compliance
We respect the intellectual property rights of others. If you believe any content on our Services infringes your copyright, please contact us at legal@oceanir.ai with a detailed notice complying with the Digital Millennium Copyright Act (DMCA).
Payment & Credits
Certain aspects of the Services may be provided for a fee or other charge. If you elect to use paid aspects of the Services, you agree to the pricing, payment, and billing policies applicable to such fees and charges.
Credit System. Credits purchased are non-transferable. Credits are valid for twelve (12) months from the date of purchase. Unused credits expire after this period unless otherwise stated in specific promotional terms.
Credit Costs. Different operations may consume different amounts of credits. Current credit costs are displayed in the application and on our pricing page. We reserve the right to modify credit costs with 30 days notice.
Subscriptions. Subscriptions renew automatically unless cancelled at least 24 hours prior to the end of the billing cycle. Cancellation takes effect at the end of the current period.
Price Changes. We may change subscription prices with 30 days notice. Existing subscribers will be notified via email before any price change takes effect.
Taxes. All fees are exclusive of applicable taxes. You are responsible for paying all taxes associated with your use of the Services.
Refunds. All purchases are final and non-refundable, except as required by applicable law. Oceanir reserves the right to issue refunds or credits at our sole discretion. Refund requests must be submitted within 14 days of purchase.
Data Processing & Retention
Your privacy is important to us. This section describes how we process and retain your data in connection with the Services.
8.1 Image Processing
Images uploaded to our Services are processed in real-time to generate geo-estimation predictions. By default, uploaded images are not permanently stored and are purged within 1 hour of processing unless you explicitly choose to save analysis history.
8.2 Analysis History
If you enable analysis history, your uploaded images and results may be stored for up to 30 days. You can delete your history at any time through your account settings.
8.3 Model Training
Oceanir does not use your uploaded images to improve our machine learning models unless you explicitly opt in through your account settings. You can change your training preference at any time. Opting out does not affect your ability to use the Services.
8.4 Data Encryption
All data transmitted to and from our Services is encrypted using TLS 1.3. Data at rest is encrypted using AES-256 encryption. We implement industry-standard security measures to protect your data.
8.5 Data Deletion
Upon account deletion, we will delete your personal data within 30 days, except where we are required to retain data for legal, regulatory, or security purposes. Anonymized or aggregated data may be retained indefinitely.
API Usage & Rate Limits
Access to our API is subject to the following terms and conditions. Permitted commercial API use depends on your subscription tier and, where applicable, your enterprise order form.
9.1 Rate Limits
API usage is subject to rate limits based on your subscription tier. Exceeding rate limits may result in temporary throttling or suspension of API access. Current rate limits are documented in our API documentation.
9.2 API Keys
API keys are confidential and must not be shared, published, or embedded in client-side code. You are responsible for all activity that occurs using your API keys. Compromised keys should be regenerated immediately.
9.3 Attribution
If you display results from our API to end users, you must include appropriate attribution to Oceanir unless otherwise agreed in writing.
9.4 Caching
You may cache API responses for up to 24 hours unless our API documentation specifies otherwise. Longer caching periods require explicit written permission.
9.5 Anti-Scraping & Automated Extraction
You must not use bots, crawlers, scrapers, browser automation, bulk extraction tools, or similar automated methods to access, query, monitor, copy, mirror, or harvest data from the Services except through explicitly authorized API methods. High-volume extraction that circumvents plan limits, concurrency controls, signed URL controls, bot defenses, or other technical restrictions is prohibited and may result in immediate suspension, legal enforcement, and recovery of damages.
9.6 Uptime
We target 99.9% API uptime but do not guarantee uninterrupted availability. Scheduled maintenance will be announced at least 24 hours in advance when possible.
Third-Party Services
The Services may contain links to third-party websites and services, or may integrate with third-party platforms and APIs.
10.1 Third-Party Links
We are not responsible for the content, privacy policies, or practices of any third-party websites or services. You access third-party sites at your own risk.
10.2 Map Services
Our Services utilize mapping services from third-party providers (e.g., Mapbox, Google Maps). Your use of these map services is subject to the respective provider's terms of service.
10.3 Payment Processors
Payment processing is handled by third-party payment processors. Your payment information is subject to the processor's terms of service and privacy policy.
10.4 Authentication Providers
If you choose to authenticate using third-party providers (e.g., Google), your use is subject to that provider's terms. We receive only the information necessary to create and manage your account.
Confidentiality
“Confidential Information” means all non-public information disclosed by a party (“Disclosing Party”) to the other party (“Receiving Party”), whether orally or in writing, that is designated as confidential or that reasonably should be understood to be confidential given the nature of the information and the circumstances of disclosure.
The Receiving Party agrees: (i) to use the same degree of care that it uses to protect the confidentiality of its own confidential information of like kind (but not less than reasonable care); (ii) not to use any Confidential Information of the Disclosing Party for any purpose outside the scope of this Agreement; and (iii) except as otherwise authorized by the Disclosing Party in writing, to limit access to Confidential Information of the Disclosing Party to those of its employees and contractors who need that access for purposes consistent with this Agreement and who have signed confidentiality agreements.
Confidential Information does not include information that: (a) was publicly known at the time of disclosure; (b) becomes publicly known through no fault of the Receiving Party; (c) was rightfully in the possession of the Receiving Party without restriction prior to disclosure; or (d) is required to be disclosed by law.
Termination
We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.
12.1 Termination by You
If you wish to terminate your account, you may simply discontinue using the Service or delete your account via the settings dashboard. Active subscriptions should be cancelled before account deletion.
12.2 Termination by Us
We may terminate your account for violation of these Terms, fraudulent activity, extended inactivity, or for any other reason at our discretion. We will attempt to provide notice when possible.
12.3 Effect of Termination
Upon termination: (a) your right to use the Services will immediately cease; (b) any unused credits will be forfeited; (c) you must cease all use of our intellectual property; (d) we may delete your data in accordance with our data retention policies.
12.4 Survival
All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Disclaimer of Warranties
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. OCEANIR DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. OCEANIR MAKES NO WARRANTY REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY GEO-ESTIMATION PREDICTIONS.
Limitation of Liability
IN NO EVENT SHALL OCEANIR, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (III) ANY CONTENT OBTAINED FROM THE SERVICE; AND (IV) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.
Maximum Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OCEANIR'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO OCEANIR IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100).
Indemnification
You agree to defend, indemnify, and hold harmless Oceanir and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of:
- Your use and access of the Service, by you or any person using your account and password;
- A breach of these Terms;
- Content posted on the Service by you;
- Your violation of any law or regulation;
- Your violation of any third-party rights, including intellectual property rights;
- Any claim that your use of the Services caused damage to a third party.
This indemnification obligation will survive termination of these Terms and your use of the Services.
Government & Law Enforcement Requests
We may be required to disclose your information in response to valid legal requests from government agencies or law enforcement.
15.1 Legal Process
We will comply with valid subpoenas, court orders, and other legal processes. We will attempt to notify you of such requests unless prohibited by law or court order.
15.2 Emergency Requests
In emergency situations involving imminent danger to life or serious physical injury, we may disclose information to law enforcement without legal process.
15.3 Transparency
We may publish transparency reports detailing the number and types of government requests we receive, subject to any applicable gag orders or legal restrictions.
Export Controls
The Services may be subject to export control and economic sanctions laws and regulations, including the U.S. Export Administration Regulations and sanctions programs administered by the U.S. Office of Foreign Assets Control.
You agree that you will not export, re-export, or transfer the Services or any technical data obtained through the Services to any country, entity, or person prohibited by applicable laws, including:
- Countries subject to comprehensive U.S. sanctions (e.g., Cuba, Iran, North Korea, Syria, and the Crimea, Donetsk, and Luhansk regions);
- Persons or entities on the U.S. Treasury Department's Specially Designated Nationals List;
- Persons or entities on the U.S. Commerce Department's Denied Persons List or Entity List;
- Any other restricted parties under applicable export control laws.
Force Majeure
Neither party shall be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from any cause beyond the reasonable control of that party.
Force majeure events include, but are not limited to: natural disasters, acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, earthquakes, pandemics, accidents, strikes, labor disputes, electrical, internet, or telecommunications outages, and government actions or regulations.
The affected party shall give prompt notice to the other party of such force majeure event and shall use reasonable efforts to mitigate the effects of such event.
Dispute Resolution
Governing Law. These Terms shall be governed and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.
Informal Resolution. Before filing any formal dispute, you agree to first attempt to resolve the dispute informally by contacting us at legal@oceanir.ai. We will attempt to resolve the dispute within 30 days.
Arbitration. At Oceanir's sole discretion, it may require You to submit any disputes arising from the use of these Terms or the Website, including disputes arising from or concerning their interpretation, violation, invalidity, non-performance, or termination, to final and binding arbitration under the Rules of Arbitration of the American Arbitration Association applying California law.
Class Action Waiver. You agree that any arbitration or proceeding shall be limited to the Dispute between us and You individually. To the full extent permitted by law, (i) no arbitration or proceeding shall be joined with any other; (ii) there is no right or authority for any Dispute to be arbitrated or resolved on a class action-basis or to utilize class action procedures; and (iii) there is no right or authority for any Dispute to be brought in a purported representative capacity on behalf of the general public or any other persons.
Exceptions. Nothing in this section shall prevent either party from seeking injunctive or other equitable relief in a court of competent jurisdiction to protect its intellectual property rights or confidential information.
General Provisions
19.1 Entire Agreement
These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Oceanir regarding the Services and supersede all prior agreements and understandings.
19.2 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect, and the invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.
19.3 Waiver
No waiver of any term or condition shall be deemed a further or continuing waiver of such term or condition or any other term or condition. Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision.
19.4 Assignment
You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction. Any attempted assignment in violation of this section shall be void.

All notices to you may be sent to the email address associated with your account. Notices to us should be sent to legal@oceanir.ai or to our physical address as listed on our website.
19.6 Headings
The section headings in these Terms are for convenience only and have no legal or contractual effect.
